For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL Natural Health AI LLC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TO THE EXTENT ANY ASPECTS OF THE FOREGOING LIMITATIONS OF LIABILITY ARE NOT ENFORCEABLE, THE MAXIMUM LIABILITY OF Natural Health AI LLC TO YOU SHALL NOT EXCEED THE GREATER OF (I) THE FEES YOU PAID TO Natural Health AI IN THE THREE (3) MONTHS PRECEDING THE DATE ON WHICH YOUR CLAIM AROSE, OR (II) $100 (ONE HUNDRED DOLLARS).

Indemnification

You agree to defend, indemnify, and hold harmless Natural Health AI LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Use or your use of the Services.

Dispute Resolution

Any dispute, claim or controversy between you and Natural Health AI LLC arising from or relating in any way to these Terms of Use, your use of any Services owned or operated by Natural Health AI LLC, or any products or services sold or distributed by Natural Health AI LLC will be resolved by binding arbitration, rather than in court.

Mandatory Informal Dispute Resolution: Before formally pursuing a Covered Dispute in arbitration, you agree to first send a detailed notice to Natural Health AI LLC by email at legal@naturalhealthai.com. You and Natural Health AI LLC agree to negotiate in good faith about the dispute. This process should result in resolution of the dispute, but if for some reason it is not resolved within 60 days after receipt of a fully completed Notice, you may initiate an arbitration.

Initiating Arbitration: Any arbitration between you and Natural Health AI LLC shall be administered by the American Arbitration Association pursuant to the AAA Consumer Arbitration Rules.

Jury Trial and Class Action Waiver: YOU AND Natural Health AI LLC ACKNOWLEDGE AND AGREE THAT YOU ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND TO THE LITIGATION OF DISPUTES IN STATE OR FEDERAL COURTS OF GENERAL JURISDICTION. PARTIES FURTHER AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN THEIR INDIVIDUAL CAPACITIES ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION.

Waiver and Severability

No waiver by Natural Health AI LLC of any term or condition set out in these Terms of Use will be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision will be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
